In the result, the Criminal Appeal is allowed setting aside the conviction and sentence recorded by the learned IX Additional District and Sessions Judge, Chittoor, Chittoor District vide judgment, dated 22.4.2021, in Sessions Case No.224 of 2016 against the appellant/accused No.9 for the offences punishable under Sections 364 (A) read with 149, 384 read with 149, 395 read with 149 read with 75, 341 read with 149, 342 read with 149 and 323 read with 149 I.P.C., and the matter is remanded back to the Juvenile Justice Board, Tirupati with a direction to the authorities concerned to try the case of the appellant/accused No.9 in accordance with the Juvenile Justice (Care and Protection of Children) Act, 2015 as early as possible. It is needless to mention that the appellant/accused No.9 shall be shifted to Observation Home, as prescribed under the Juvenile Justice (Care and Protection of Children) Act, 2015.
