Petition under Order 39 Rule 1 & 2 R/w. Section 151 of C.P.C., praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to grant ad-interim injunction restraining the Respondents/Defendants, their men, agents, contractors, assignees, alienees, administrators, successors in interest and all other persons or anyone else claiming through them in' any manner, from alienating including interfering with the possession of the Appellants over the suit schedule property i.e., all that the place of land admeasuring to an éxtent of 6030 Sq. Yards in T.S.No. 1012, Block No. 40 of Waltair Ward, Visakhapatnam, which is bounded by North : Joint Collector Bungalow, South : Road, East officers Club, West : Road either by way of registered, unrégistered document, deed or in any other mode of transfer/conveyance or alienation in favour of any third parties, pending disposal of A.S.No. 228 of 2020 on the file of High Court as against the impugned Decree and Judgment passed by the VII Additional District and Sessions Judge at Visakhapatnam passed in 0.S.No. 126 of 2005 dated 21-05- 2020.

The court while directing issue of notice to the Respondents herein to show cause as to why this application should not be complied with, made the following order.(The receipt of this order will be deemed to be the receipt of notice in the case). .

ORDER:-

"Heard both the counsel.

We are informed during the pendency of the suit, an injunction restraining the respondents from alienating the suit property was passed.

Appeal is continuation of the suit proceedings.

That apart, learned counsel for the respondents also submits that his clients undertakes not to alienate the suit property pending the appeal.

Having regard to the facts and circumstances of the case and considering the submissions of both the counsels, we direct there shall be an interim injunction restraining the respondents from alienating the suit property in any manner whatsoever during the pendency of the appeal, subject to the condition that the petitioners/appellants deposits the deficit court fee with costs within four weeks from today."
