Kumar presented this Second Appeal under Section 100 CPC praying that in the
circumstances stated in the memo of grounds filed herein the High Court may be
pleased to set aside the Judgment and Decree dated 06.07.2007 in O.S.NO.46/1998 on
the file of the Senior Civil Judge, Machilipatnam, Krishna District and confirm by the
District Judge, Krishna Districton 10.10.2012 in AS.No.164/2007.and allow the suit with
costs. '
AND WHEREAS the High Court upon perusing the petition and
memorandum of grounds filed herein and upon hearing the arguments of Sri S Ashok
Anand Kumar, Advocate for the Petitioner, directed issue of notice to the Respondents
