This application came to be filed by the petitioner/defendant seeking extension of time for depositing 50% of the decretal amount along with costs, as directed by this Court on 24.02.2021 in I.A.No.1 of 2021.

This Court, by order dated 24.02.2021, granted interim stay of operation of the preliminary decree and judgment, dated 17.09.2019 in OS.No.216 of 2014 on the file of the learned XII Additional District Judge, Guntur for a period of eight weeks on condition of the petitioner depositing 50% of the decretal amount along with costs, if any, before the Court below within six weeks from the said date. It was also stated that in case, the petitioner fails to comply with the order, the stay shall stand vacated automatically without reference to the Court.

It is stated by the learned counsel for the petitioner that because of the Covid pandemic, the petitioner could not raise funds to comply with the order of this Court. It is further stated that the petitioner is suffering with old age ailments and as such could not secure such huge amount.

Having regard to the facts and circumstances of the case, the time granted for depositing 50% of the decretal amount along with costs, if any, before the Court below, is extended for a period of one week from today. On such deposit being made, further operation of the preliminary decree will be stayed.
