Sri B.Ranga Swamy, learned counsel for the petitioner, questions the order impugned wherein the application filed seeking divorce was dismissed on the ground that the said Court has no jurisdiction to entertain the same. According to him, though the marriage took place in church, but as the parties are Hindus, they have every right to make an application under Section 13 of the Hindu Marriage Act, 1955 seeking divorce. He placed reliance on a judgment of the composite High Court at Hyderabad in V.Bhagyalaxmi vs. V.Rahul Kumar [2008 (3) ALT 32]. He also took us through the provisions of the Indian Marriage Act and the Christian Marriage Act and argued the matter in extensive to say that the application under Section 13 of the Hindu Marriage Act is maintainable.
Since the issue involves question of law, we requested Sri P.Veera Reddy, learned Senior Counsel, to assist the Court on the last occasion. The issue involved was also explained to him but however, he seeks a week's time.
List on 09.12.2021 treating the matter as part heard since the Court has heard the argument of the petitioner extensively.
