After considering the submissions
made by the learned counsel for the
petitioner and the learned Government
Pleader for Services-I, the issue that arises
is whether the respondents could limit the
employment only to the people who were sponsored by the Employment Exchange. The Judgment of the leaned single Judge of this Court and of the Hon'ble Supreme Court of India are to the effect that the restriction of selection only to the candidates sponsored by Employment Exchange is not proper. This is a matter which requires deeper investigation.
But as there is only one post / one vacancy and as this Court is of the opinion that the counsel has made out a prima facie case there shall be a direction to the respondents not to fill up the post of Office Subordinate, reserved for Schedule Caste and Scheduled Tribe in the backlog vacancies for a period of two weeks, if the same is not already filled up by this date.
