Heard Sri P.Durga Prasad, learned Standing Counsel for A.P.S.R.T.C. appearing for the appellant and Sri Gantasala Uday Bhaskar, learned counsel for the 1st respondent.
Pursuant to office objection raised as to the delay, the appellant herein filed I.A.No.1 of 2021 seeking condonation of delay of 21 days to which learned counsel for the 1st respondent seeks four weeks' time to file counter.
However, learned counsel for the appellant submits that there is no delay in filing appeal in view of the judgment of the Hon'ble Apex Court.
Be that as it may, the issue as to whether there is any delay in filing appeal requires consideration.
As seen from the impugned order, the learned Single Judge directed respondents in the writ petition to pay 50% of the back wages mainly on the ground that the petitioner/1st respondent was not gainfully employed during the said period, which fact is seriously disputed by learned counsel for the appellant stating that the 1st respondent was working as Village Revenue Officer from 24.05.2008 which is evident from the certificate issued by Tahsildar and the salary certificate annexed to the writ petition.
In view of the above, learned counsel for the 1st respondent submits that he will not press the contempt case filed against the order impugned in the writ appeal, if it is listed, for a period of four (4) weeks.
Post on 06.09.2021 for filing counter by the learned counsel for the 1st respondent.
