                     This is an application filed by the petitioner
               seeking condonation of the delay of (479) days in
               filing the present appeal.

                     Heard Sri V. Surya Kiran Kumar, the
               learned counsel for the petitioner.

                     It is represented by Sri P. Gopala Krishna,
               learned counsel for the respondent that he has

no objection for condonation of delay in filing the appeal.

Accordingly, the application is allowed and the delay is condoned.

This is an application filed seeking suspension of the decree and judgment dated 29.12.2016 passed in L.A.O.P. No.1 of 2013 on the file of the learned Additional Senior Civil Judge, Gajuwaka, Visakhapatnam.

Heard the learned counsel for the petitioner.

It is represented by the learned counsel appearing for the petitioner that the respondent

has filed Execution Petition seeking attachment of the property before the Court below and hence, he sought for suspension of the order passed by the Court below subject to payment of the 50% of the decretal amount.

Sri P. Gopala Krishna, learned counsel for the respondent/claimant has no objection for grant of suspension of the order. But however submits that the respondent/claimant may be permitted to withdraw the said deposited amount.

In view of above, there shall be an interim suspension of the decree and judgment dated 29.12.2016 passed in L.A.O.P.No.1 of 2013 on the file of the Court of Additional Senior Civil Judge, Gajuwaka, Visakhapatnam, subject to condition of petitioner depositing 50% of the decretal amount with costs within a period of six (06) weeks from today, in default, the said order shall stand vacated. The respondent/ claimant is permitted to withdraw the amount so deposited without any security.
