CRIMINAL PETITION No.2294 of 2021
ORDER:
The petitioners are accused Nos.2, 4 and 6 in
C.C.No.199 of 2018 in the Court of Judicial First Class
Magistrate, Parchur.
2. Sri Chalasani Venkaiah, learned counsel for the
petitioners would submit that there are no specific allegations
made against the petitioners and all the allegations made
against the petitioners are general and vague allegations made
only for the purpose of roping in the family of accused No.1/
husband. He relies upon a Judgment of Geeta Mahrotra vs.
State of U.P.1 to contend that the said C.C. requires to be
quashed.
3. As a charge sheet has already been filed before the
trial Court and the matter is pending trial before the trial Court,
it would be appropriate to dispose of this criminal petition with
liberty to the petitioners to raise all defences and issues raised
herein before the trial Court.
4. The presence of the petitioners shall also be
dispensed with in C.C.No.199 of 2018 in the Court of Judicial
First Class Magistrate, Parchur, except when the trial Court
specifically requires their presence.
5. Accordingly, the criminal petition is disposed of.

As a sequel, pending miscellaneous petitions, if any, shall
stand closed.
