1. Heard learned Counsel for the applicant and learned A.G.A.

2. The present application has been filed seeking quashing of the non-bailable warrant and orders dated 21.08.2025 and 17.10.2025 passed by learned trial court and permit to the petitioner to appear before the trial court in Criminal Case No.508/2009, vide Case Crime No. 217/2009, under Section 2/3 Uttar Pradesh Gangster and Anti Social Activities (Prevention) Act, 1986, P.S. GRP, Lucknow, pending in the court of Special Judge, Gangster Act, Lucknow.

3. It is submitted by the Counsel for the applicant that while issuing the non-bailable warrant, the court below has ignored the law as explained in the case of Inder Mohan Goswami vs State of Uttaranchal: (2007) 12 SCC and passed the order in the mechanical manner 4. In view of above and considering the judgment of the Inder Mohan Goswami (Supra), the impugned non-bailable warrant dated 21.08.2025 and the consequential orders are quashed subject to the applicant furnishes fresh sureties and co-operates with the trial.

5. The applicant is allowed.
