1. Heard Mohd. Imran Khan, learned counsel for the petitioner, Shri Ambrish Shukla, learned Additional Chief Standing Counsel for the State respondents and Mohd. Afzal, learned counsel for Real Estate Regulator Authority.
2. In pith and substance the petitioner is invoking the writ jurisdiction for compliance of judgment and order passed by Real Estate Regulatory Authority i.e. respondent no.3.
3. Learned counsel for Real Estate Regulatory Authority raised an objection qua the maintainability of writ petition on the premise that the petitioner is having efficacious remedy for execution of the order passed by UPRERA as the RERA Act is self contained Act and all remedial measures are provided in the Act itself for execution of the said order.
4. Confronted with the situation, learned counsel for the petitioner submits that the instant writ petition may be dismissed as not pressed and leave may be accorded to the petitioner to press his relief under the RERA Act.
5. Accordingly, the writ petition is dismissed as not pressed. Needless to say, it is open to the petitioner to press his relief before the appropriate forum.
