By means of this petition the petitioner, who is the informant, is seeking a writ of mandamus directing the opposite parties/State of U.P. to investigate the Crime No. 236 of 2023 under Sections 419, 420, 467, 468, 471, 504, 506 IPC, P.S. Tarabganj, District Gonda in fair and impartial manner by higher authorities not below the rank of Superintendent of Police, within specific time.

The petitioner is aggrieved by the pace and manner of the investigation. He has lodged an F.I.R. abovementioned. He has named the accused.

Without expressing any opinion on merits of the allegations as the investigation is still pending, let the petitioner approach the respondent no. 2, Superintendent of Police, Gonda raising his grievance, who shall get the matter inquired and do the needful but only as per law. However, if the petitioner is still aggrieved that is inspite of the aforesaid, he may approach the Judicial Magistrate concerned in this regard in view of the judgment of Hon'ble the Supreme Court rendered in the case Sakiri Vasu Vs. State of U.P. and Ors. reported in (2008) 1 SCC (Crl.) 440.

With the aforesaid observations/directions, the writ petition is disposed of.
