Heard the counsel for the petitioners.

The present petition has been filed for the following relief:-

"(i) Issue a writ, order or direction in the nature of Mandamus commanding the respondents to grant pensionary benefits to the Petitioners / Tubewell Operator having qualifying service being engaged as Tubewell operator since their date of appointment.

(ii) Issue a writ, order or direction in the nature of Mandamus commanding the respondents extend the benefit of Old Pension Scheme to the Petitioners in terms of the Prem Singh Vs. State of U.P. and Others (Civil Appeal No. 6798 of 2019 and other connected matters).

(iii) Issue a writ, order or directing in the nature of Mandamus commanding 2nd respondent to consider and decide the representation Dt. 07.02.2024, 04.05.2024 (Annexure No.5) regarding grant of pensionary benefits in the light of judgment / order Dt.02.09.2019 passed by Hon'ble Apex Court in Prem Singh Vs. State of U.P. and Others (Civil Appeal No. 6798 of 2019 and other connected matters."

The claim of the petitioners can be considered by the Executive Engineer, Nalkoop Khand - I Orai, District Jalaun.

The petitioners may file a fresh representation before the Executive Engineer, Nalkoop Khand - I Orai, District Jalaun who shall decide the same within a period of four months from the date of filing the same and in case, the petitioners are found entitled to the claim made by them, the same shall be disbursed to them within the next period of one month.

With the aforesaid direction, the writ petition is disposed of.
