1. Heard learned counsel for the parties.

2. Instant writ petition has been filed, inter alia, for the following relief :-

"Issue a writ, order or direction in the nature of mandamus commanding directing to the respondent No.2 to decide the application of the petitioner under Section 6-H(1) of 1947 Act which filed before the respondent No.2 which was pending since near about 3 years."

3. It is submitted that the petitioner has filed application under Section 6-H(1) of U.P. Industrial Disputes Act, 1947, in pursuance of the judgment/award dated 17.09.2018 passed in Adjudication Case No.179 of 2007, however, till date, said application has not been decided by the Deputy Labour Commissioner, Aligarh (respondent no.2).

4. Learned Standing Counsel has no objection, in case, a direction is issued to respondent no.2 to decide the aforesaid application, within stipulated period as directed by this Court.

5. In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to dispose of the present writ petition finally, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to respondent no.2 to decide the aforesaid application, in accordance with law, expeditiously, preferably, within a period of four months from the date of receipt of certified copy of the order of the date.

6. With the aforesaid direction, present writ petition is disposed of.
