Civil Misc. Delay Condonation Application No. NIL of 2023 :

1. This application has been filed for condoning the delay in filing the Review Application.

2. In view of the averments made in the affidavit filed in support of the application under Section 5 of the Limitation Act, we are satisfied that the applicant was prevented by sufficient cause from preferring the Review Application within the period of limitation.

3. The application is allowed. The delay in filing the Review Application is, accordingly, condoned.

Learned counsel appearing for the Prayagraj Development Authority, upon a specific query being made as to whether there was any notice under section 10(6) of the Urban Land (Ceiling & Regulations) Act, 1976, learned counsel for the PDA could not give any specific and satisfactory answer and in fact has stated that there was no notice.

5. Having heard learned counsel for the PDA and Sri Mansoor Ahmad, learned counsel for the opposite parties, we are of the view that no review of the judgment and order dated 15.3.2022 is required to be done.

6. The application is, accordingly, rejected.
