1. This is the second bail application. First bail application of applicant was rejected on 30.11.2022.
2. Applicant has approached this Court seeking enlargement on bail in S.T. No.358 of 2020, arising out of Case Crime No.68 of 2020, under Sections 498-A, 304-B and 504 I.P.C. and Section 3/4 of D.P.Act, Police Station-Balua-District-Chandauli.
3. Sri Anil Kumar Pal and Sri Pankaj Kumar Gupta, learned counsel for the applicant are not present. Sri R.K.Mishra, learned A.G.A. and Sri R.P.Rajan, learned counsel for the informant are present.
4. Sri R.P.Rajan, learned counsel for the informant submits that during pendency of this bail application trial has been concluded so much as that argument has already been heard and it is at the stage of pronouncement of judgment.
5. In the aforesaid circumstances, considering that trial has been concluded and it is at the stage of pronouncement of judgment as well as taking note that immediate cause of death was by administering poison as indicated in the viscera report, therefore, even in the absence of learned counsel for the applicant, this bail application is disposed of with a direction to learned Trial Court to pass the judgment within a shortest period.
6. A copy of this order be sent to the applicant through concerned Jail Superintendent.
7. Registrar (Compliance) to take steps.
