1. At the very outset, learned counsel for the appellants-State submits that controversy involved in the instant appeal is same as that of in Special Appeal Defective No. - 768 of 2023 (State of U.P. and 2 Others Vs. Jay Prakash Singh), which has been dismissed as withdrawn today itself with detailed observations and accordingly, he submits that the same may be dismissed as withdrawn, in terms of the judgment and order passed in the aforementioned special appeal.

2. So far as the factual and legal controversy is concerned, the same is not disputed by the learned counsel appearing for the respondent.

3. In view of the above, the instant special appeal stands dismissed as withdrawn in terms of the aforementioned judgment passed in Special Appeal Defective No.- 768 of 2023 (State of U.P. and 2 Others Vs. Jay Prakash Singh).
