1. List revised. Sri Vijay Kumar Rai, learned counsel for the appellant and Sri Birendra Pratap Singh, learned State counsel is present, who have been heard.

2. The present appeal has been filed by the appellant against the judgment and order dated 03.12.1982 passed by Judicial Magistrate-I, Agra in Case No. 1314 of 1980, Police Station Hariparvat, District Agra.

3. As per office report dated 10.05.2024, a report from C.J.M. concerned was called for regarding living status of the accused-respondent in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 16.11.2021 informed that the accused-respondent - Jagmohan has died. The said report has been sent after due enquiry.

4. Accordingly, the appeal stands abated.

5. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks from today.
