1. Heard Sri Mayank Bhushan Nath Tripathi, learned counsel for the appellant and Sri Krishna Dutt Awasthi, learned counsel appearing on behalf of the respondent.

2. This present appeal has been filed seeking following relief:

"The relief sought is that this Hon'ble Court may graciously be pleased to allow this appeal with cost and to set-aside the judgment, order and decree passed by the Trial court and may judgment, order and Decree passed by the Trial court and may also grant such other further relief which this Hon'ble court may deem fit and proper in the facts and circumstances of the case, failing which the appellant will suffer irreparable loss and injury."

3. Both the learned counsels for the parties agree that the matter has been settled between the parties peacefully, therefore, the appeal may be dismissed as withdrawn.

4. Accordingly, the present appeal stands dismissed as withdrawn.
