Case :- CONTEMPT APPLICATION (CIVIL) No. - 3033 of 2024

Applicant :- Ramveer Singh

The writ Court on 20.09.2023 in Writ-C No.27364 of 2023 had passed the following order:-

"1. Heard Sri Ram Mohan, learned counsel for the petitioner and Sri Ambrish Shukla, learned Additional Chief Standing Counsel for the State respondents.

2. Learned counsel for the petitioner states that he has filed an application before the District Magistrate on 26.06.2023, which has already been endorsed to the Sub-Divisional Magistrate concerned for actual demarcation of the land in dispute but till date the said exercise has not been carried out.

3. Per contra, learned ACSC submits that the U.P. Revenue Code is itself a self-contained Act and in case the petitioner is aggrieved, he may invoke the remedy as available in law by moving an appropriate application for demarcation of his holding.

4. Considering the facts and circumstances, we are not inclined to keep this matter pending. However, in case the petitioner moves an appropriate application before the competent authority as per law, the same shall be disposed of as per law.

5. With the aforesaid liberty, the writ petition is disposed of."

From the perusal of the aforesaid order, it is clear that neither any direction was issued by the writ Court, nor there is any judgment of the Court which has been flouted by the opposite party.

No case for contempt is made out.

Contempt application is misconceived and the same stands dismissed.
