1. Heard learned counsel for the petitioner.

2. Present petition has been filed with following prayer:-

"(i). Issue an order/direction to trial Court to expedite the small cause court Execution Case No. 01 of 2004 (Tej Pratap since deceased and others vs. Jagdish) arising out of judgment and decree dated 14.03.1997 passed in small cause suit no. 21 of 1991, pending before Civil Judge (J.D.), Court No. 10, Deoria, within stipulated period."

3. Learned counsel for petitioner submitted case is pending since long, therefore, a direction may be issued to decide the same at the earliest.

4. I have considered the submission made by learned counsel for petitioner and perused the records.

5. In the facts and circumstances of the case, the present petition is disposed of with direction to Civil Judge (J.D.), Court No. 10, Deoria to decide the aforesaid case in accordance with law, maximum within a period of four weeks from the date of production of certified copy of this order after providing opportunity of hearing to all concerned and without granting any unnecessary adjournment to either of the parties. In case, adjournment is granted, Court shall record reasons for adjournment and may impose cost, if required.
