1. The present special appeal has been preferred for setting aside the judgment and order dated 13-02-2013 passed by the learned Single Judge in Writ-A No. 69354 of 2006 (Gopal Bansal Vs. State of U.P. and others).

2. Sri Prashant Bharti, counsel holding brief of Sri Ramendra Asthana, learned counsel for the appellant on the instructions, states that the present special appeal may be dismissed as not pressed.

3. Sri Ashwani Tripathi, counsel holding brief of Sri Raghuvansh Misra, learned counsel for the respondent no.6 and Sri Pankaj Rai, learned Additional Chief Standing Counsel have no objection .
