1. Heard Mr. Harish Chandra Mishra, Counsel for the petitioner and Mr. Amit Kumar Shrivastava, learned Standing Counsel for State-respondents.

The instant writ petition has been filed praying for a mandamus directing respondent No.1, Commissioner, Jhansi Division, Jhansi to decide the case No. 369 of 2016, Computerized case No. C2016060000369, Satyendra SIngh and Others Vs. Smt. Usha Singh and Others under Section 207 of U.P. Revenue Code, 2006 within stipulated period.

3. Counsel for the petitioner submitted that against the judgment and decree passed in the suit under Section 229-B of U.P.Z.A. and L.R. Act, appeal under Section 207 of the U.P. Revenue Code, 2006 filed by petitioner along with others is pending before respondent no.1. He further placed the copy of the order sheet/ pending appeal in order to demonstrate that case is not proceeding expeditiously in spite of the expiry of more than seven years.

4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.1, Commissioner, Jhansi Division, Jhansi to consider and decide the aforementioned appeal in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
