1. Heard learned counsel for the petitioner as well as learned A.G.A. for the State.

2. The instant writ petition is filed with a prayer to stay the operation and effect of impugned judgment and order dated 01.09.2023 passed by Additional District Magistrate (Judicial) Sonbhadra, in Case No. 2340 of 2022 (Computerized Case No. D202216660002340) under Section 3(1) of U.P. Gunda Control Act, 1970, Police Station- Chopan, District- Sonbhadra.

3. The petitioner is aggrieved by an order of externment passed against him under Section 3(1) of the U.P. Control of Gangsters Act, 1970. Against the order impugned, the petitioner has statutory alternative remedy of filing an appeal under Section 6 of the Act. This statutory remedy has not been availed.

4. Under the circumstances, petition is dismissed on the ground of availability of statutory alternative remedy.
