Heard Sri Kuldeep Kumar, learned counsel for the appellant.
Present appeal has been preferred under Section 173 of the Motor Vehicles Act, 1988 against the judgment and award dated 03.02.2022 passed by the Motor Accident Claims Tribunal, Banda in Claim Petition No. 182/79 of 2019.
The Stamp Reporter has submitted a report pointing out that the appeal is not maintainable in view of the provisions under Section 173 (1) of the Motor Vehicles Act, 1988.
Counsel for the appellant has not disputed that the appeal under Section 173 of the Motor Vehicles Act, 1988 would not lie when the amount in dispute is less than Rs. 1 lakh.
Learned counsel accordingly states that he does not wish to press the appeal.
The appeal stands dismissed accordingly.
Office to return the amount of statutory deposit made by the appellant.
