1. Heard learned counsel for petitioners and learned State Counsel for opposite parties.

2. Petition has been filed seeking a direction to opposite parties to provide all service benefits as applicable to government employees including pension to the petitioners by extending benefit of judgment and order rendered by Division Bench of this Court dated 18.05.2016 passed in Writ Petition No.352 (S/B) of 2014; (Dinesh Kumar Sharma & Others Vs. State of U.P. & Another).

3. It has been submitted that petitioners are similarly situated as the petitioners of aforesaid writ petition and are therefore be directed all the benefits granted in the said writ petition.

4. Learned Stated Counsel, however, submits that against the aforesaid judgment, a Special Leave Petition has been filed which has been converted into Civil Appeal No.1080 of 2017 and is pending consideration, although judgment of this Court in the aforesaid case has not been stayed till date.

5. Considering the aforesaid facts, particularly, that petitioners are similarly situated as petitioners of the aforesaid writ petition in the case of Dinesh Kumar Sharma (supra), it is directed that petitioners shall also be granted the same benefit as has been made applicable to the petitioners of the aforesaid writ petition by means of judgment and order dated 18.05.2016. It is needless to state that such benefits shall be subject to final decisions in Civil Appeal No.1080 of 2017 pending before the Hon'ble Supreme Court.

6. With the aforesaid direction, the petition stands disposed of.
