Heard Sri Anand Dubey, learned counsel for the petitioners.

This petition under Article 227 of the Constitution of India has been filed challenging the judgment and order dated 19.07.2023 passed in Civil Revision No.7 of 2020(Ram Bahadur & Others versus Sriram & Another) by the District Judge,Pratapgarh, by means of which the order dated 23.09.2019 passed in Regular Suit No.957 of 2003(Sriram versus Raghunath and others) by the Additional Civil Judge(J.D.) Court No.21, Pratapgarh has been set aside and the matter has been remitted back to decide the issue no.8 in view of the observations and findings given in the judgment of the revisional court.

Learned counsel for the petitioners after arguing at some length submits that the petition may be dismissed as not pressed to enable him to pursue before the concerned court.

Dismissed accordingly as not pressed with liberty as aforesaid.
