The present petiton has been filed challenging the order dated 28.10.2022 whereby the claim of the petitioner for reimbursement of medical expenses spent on the treatment of his wife has not been paid only on account of the fact that requisite documents are not available with the respondents.

In the present petition, the claim of the petitioner is that he was entitled for reimbursement of medical expenses which were duly approved by the Chief Medical Officer and it is not the fault of the petitioner if documents are not traced. In any case, the submission of the petitioner is that the petitioner is ready and willing to furnish the documents afresh.

In view of the said submission, the present petition is disposed off permitting the petitioner to file the document on the basis of which the claim is made within a period of two weeks from today. The respondents shall, thereafter, process the claim and if required, seek clarification from the Office of Chief Medical Officer. The Chief Medical Officer concerned shall cooperate with the respondents or the petitioner in providing the requisite document. In any event, the respondent no. 2 shall process the claim after verification and submission of the documents by the petitioner within a period of six weeks from the date of receipt of document.

While doing so, the respondent shall take into consideration the judgment of this Court passed dated 13.2.2023 in the Writ A No. 2000284 of 2014 in re: Mohammad Aslam and 4 Ors. Vs. State of U.P. and Ors.
