(I.A. No.2 of 2022-Delay Condonation Application)

The review application is filed with a delay of around five years for review of judgment and order dated 16.08.2017.

The sole ground for condoning the delay, taken in paragraph-3 of the affidavit filed in support of delay condonation application, is that petitioners could not come to know about the order dated 16.08.2017 due to Covid-19 situation and when they came to know about the order they tried to contact their counsel but could not contact due to missing phone number of counsel.

There was no Covid-19 situation in the year 2017. The same arose in the beginning of the year 2020, hence, the ground taken for condoning the delay is not bona fide.

In view thereof, no case for condoning the delay is made out.

The delay condonation application is rejected.

Order on Review Application:-

Since, the delay condonation application is rejected, as a consequence, review application is also rejected.
