Criminal Appeal No.5954 of 2018 along with connected Criminal Appeal Nos. 5924 of 2018, 6012 of 2018 and 6457 of 2018 has been placed before this Bench.
We have conveyed our feeling that the genesis of the offence is from business rivalry. Most of the accused-appellants have already been enlarged on bail. Accused-appellant, Himanshu Soni, in Criminal Appeal No.5924 of 2018 is in jail fore more than nine years and has filed second bail application. The Apex Court has directed to expedite the matter in case of accused- appellant Nandu Singh in Criminal Appeal No.6012 of 2018 who has already been granted bail and the bail order were challenged.
Looking to the facts and circumstances, if the parties wish to avail the benefit of judgment of Ankush Shiivaji Gaikwad Versus State of Maharashtra, (2013) 6 SCC 770, they may convey this Court on 9.5.2023.
List on 9.5.2023 as fresh.
