Present criminal appeal challenges judgment and order dated 02.04.2010 passed by the Additional Sessions Judge, Court No.10, District Ghaziabad in Sessions Trial No.471 of 2006 (State of U.P. vs. Prithvi Narayan Pandey and another) whereby the learned Additional Sessions Judge has convicted the accused-appellants, Prithvi Narayan Pandey and Nag Narayan Pandey for commission of offence under Sections 452, 302/34, 307/34 of Indian Penal Code, 1860 (for short 'IPC') and sentenced them to undergo rigorous imprisonment for life under section 302/34 IPC with fine of Rs.2,000/- each; further undergo rigorous imprisonment for ten years under section 307/34 IPC with fine Rs.1000/- each and further undergo rigorous imprisonment under section 452 IPC for three years with fine of Rs.500/- each and in case of default in payment of fine, further to undergo six months' simple imprisonment.
Learned Standing Counsel submits that both the accused have been granted remission and they have been released from prison on remission.
In view of the matter, we are of the considered opinion that nothing more remains to be done in this matter and we dispose of this appeal.
