List has been revised. None is present for the appellant to press the appeal. The learned Standing Counsel is present for respondent nos. 1 and 2.

We have perused the record. It appears to us that Writ-C No. 42868 of 2010 out of which the present appeal arises was filed against the order of reference dated 15.05.2010. The challenge to the reference order was dismissed by the impugned judgment and order dated 18.07.2014. There appears no interim order passed in this appeal.

In such circumstances, this appeal must have been rendered infructuous and therefore, no one is interested in pressing the same.

In view of the above, the appeal is dismissed for non prosecution.
