Present criminal revision is pending at the stage of admission.

None appears for the revisionist even in the revised call to argue on the point of admission, however, Shri Saurabh Srivastava, learned A.G.A. is present.

Present criminal revision has been preferred to set aside the judgment and order dated 17.7.2008 passed by Additional Sessions Judge, Chandausi, Moradabad by which the trial court affirmed the judgment and order dated 31.1.2008 passed by Additional Chief Judicial Magistrate, Chandausi, Moradabad by which the revisionist was convicted and sentenced under Section 382, IPC to undergo three years rigorous imprisonment and fine of Rs. 2,000/- and in default of payment of fine, one month additional rigorous imprisonment.

In view of the above facts and circumstances, present criminal revision is dismissed at the stage of admission.

Office is directed to send back the record of the trial court immediately.
