Heard Mohd. Alam, learned counsel for the appellant and perused the records.

The instant first appeal has been filed seeking following main relief:

"Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the impugned order and judgment dated 02.11.2022 as well as formal order dated 13.1.2023 passed by First Additional Principal Judge, Family Court, Hardoi in regular suit no.514/2021, Shahzad Ali Vs. Smt. Umaira Fatima alias Juli in Suit for Rukhsati and may further be pleased to allow the instant first appeal of the appellant/ plaintiff in the interest of justice."

Learned counsel for the appellant submit that he does not want to press the appeal as the appellant intends to withdraw the suit from which the instant appeal arises.

Accordingly, the first appeal is dismissed as not pressed.
