Heard Shri Rajesh Kumar Singh, learned counsel for the applicant and learned A.G.A. Perused the record.
By means of the present 482 application the applicant is challenging the legality and validity of impugned judgment and order dated 22.8.2022 passed by learned Civil Judge (S.D.)/Additional Chief Judicial Magistrate, Kasia, Kushinagar in Misc. Case No.810 of 2022, u/s 156(3) Cr.P.C. (Arif vs. Ayenulhaq), P.S.-Kubersthan, District Kushinagar.
This application u/s 482 Cr.P.C. is not maintainable, as against the order whereby the applicant is aggrieved, a revision is maintaible. Therefore, this 482 application is dismissed as not maintainable.
Under the circumstances, if the applicant so advised, may file a fresh revision challenging the impugned order.
Certified copy, if any, be returned to the learned counsel for the applicant within a week after having its photocopies.
