Civil Misc. Correction Application No. 2 of 2023

Heard Shri Vinod Kumar Singh, learned counsel for the applicant in support of the correction application.

The writ petition was disposed of vide order dated 02.11.2022 requiring the respondent No. 3- District Basic Education Officer, District-Deoria, to decide the representation of the petitioner dated 12.09.2022 in light of the judgment passed in the case of Usha Rani, in accordance with law, within a period of three months from the date of production of a certified copy of this order.

Learned counsel for the applicant submits that the representation dated 12.09.2022 was addressed to the Finance and Accounts Officer, in the office of the District Basic Education Officer, District Deoria and, therefore, the order may be modified by requiring the petitioner to prefer a fresh representation to the District Basic Education Officer, District Deoria which may be decided within three months.

In view of the submissions, the application is allowed.

The directions under the order dated 02.11.2022 is modified by permitting the petitioner to file a fresh representation, addressed to the District Basic Education Officer, District Deoria, within two weeks and in turn the District Basic Education Officer, District Deoria may proceed to decide the representation dated 12.09.2022 within a period of three months from the date of production of certified copy of the modified order of this Court.

This order shall be treated as part of the order dated 02.11.2022. A certified copy of this order shall also be supplied along with the order dated 02.11.2022.
