Heard Shri Pankaj Srivastava, learned counsel for the petitioner and Shri Vikram Bahadur Yadav, learned counsel for the State-respondents.

By means of the instant petition, the petitioner seeks a writ in the nature of mandamus directing the respondents to release withheld pension of the petitioner since the date of superannuation i.e. on 30.04.2022.

In pursuance of the order passed by this Court dated 14.12.2022, learned Standing Counsel was required to seek instructions and indicate why the pension has not been released and in response thereto it has been informed that the petitioner is required to submit the copy of the Judgment in Writ-A No.4631 of 1996 and in case if the same is submitted, necessary process to release the pension shall be initiated and done. Noticing the stand of the State in the written instructions dated 03.01.2023, a copy of which has been provided to the Court for perusal and the same is taken on record.

This Court disposes of the petition with the direction to the petitioner to furnish the certified copy of the Judgment passed in Writ-A No.4631 of 1996 within a period of two weeks from today. In case if sch certified copy of the judgement is submitted before the authority concerned within a period of two weeks, they shall do the necessary exercise and release the petition within a period of four weeks thereafter provided there is no legal impediment and in case of any deficiency or impediment the same shall be informed to the petitioner in writing within the aforesaid period.

With the aforesaid, the petition is disposed of.
