Heard Sri Satya Mohan Singh, learned counsel for the applicants and Sri B.B. Upadhyay, learned counsel for the State and perused the record.
The present application under Section 482 Cr.P.C. has been filed by the applicants Birendra Pandey and Dilip Pandey with the prayer to allow this application and quash/set-aside the order dated 17.11.2022 passed by Additional District and Session Judge, Court No.1, Gorakhpur in Criminal Revision No. 174 of 2021 in Criminal Case No. 1026 of 2016 as well as the entire proceeding in Case Crime No. 382 of 2014 and with a further prayer to stay the further proceedings in the said case, during the pendency of the present application.
After arguments at length, learned counsel for the applicants states that the parties have entered into a compromise on the basis of which the civil suit pertaining to the said dispute has been decided. He further submits that the present application under Section 482 Cr.P.C. be dismissed as withdrawn as the said compromise and the judgment of the civil court would be filed before the concerned trial court at the first instance for which liberty be granted.
Prayer is allowed.
The present application is dismissed as withdrawn.
