This writ petition has been filed with a direction upon respondent educational authorities for payment of current salary as well as arrears of salary payable to the petitioner who is working on the post of Assistant Teacher under the provisions of the Payments of Salaries Act, 1971.
Learned counsel for the petitioner submitted that the petitioner is entitled for the relief in view of the judgment rendered by co-ordinate Bench of this Court in case of Dhruv Narain Singh vs. State of U.P. and others, decided on 13.01.2017.
Ventilating his grievance, petitioner has moved a representation before the authorities which is pending consideration and has been appended as Annexure-7 to the writ petition.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no. 4, District Inspector of Schools, Ballia to consider and decide the representation of the petitioner, if there are no legal impediments and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of three months from the date of production of certified copy of this order.
It is made clear that the Court has not adjudicated upon the merits of the case.
Writ petition stands disposed of.
