Judgement Date : 3 February, 2023
HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 34 Case :- WRIT - A No. - 21990 of 2022 Petitioner :- Tejpal Singh Respondent :- State Of U P And 2 Others Counsel for Petitioner :- Agnihotri Kumar Tripathi Counsel for Respondent :- C.S.C.,Pranesh Dutt Tripathi Hon'ble Saurabh Shyam Shamshery,J.
Petitioner has participated in recruitment process for Assistant Teacher held in the year 2016, but he was not selected. Now, he has come up with the plea that he may be appointed against vacant posts which are still vacant and were not carried forward in subsequent recruitment process and has referred to a document annexed along with writ petition in this regard.
Learned counsel for respondents submits that process initiated in the year 2016 has already been concluded as well as right of petitioner, if any, has already been extinguished.
Considering the above submission and on the basis of facts referred above and also considering judgment of Supreme Court in the case of State of U.P. & Ors, Vs. Pankaj Kumar (2022) 1 SCC 335, wherein it was held that "........a line has to be drawn at some stage as otherwise, the recruitment process undertaken by the competent authorities would be meaningless without a timeline and the next recruitment process will also get affected.....",since recruitment process of year 2016 has undisputedly concluded and thereafter subsequent recruitment process are also concluded, therefore, prayer of petitioner to consider him against vacant post cannot be accepted at belated stage.
The writ petition is dismissed.
