1. Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal despite the fact that there are two counsels appearing in the matter. Sri Ram Prakash Shukla, learned counsel for the State is present.

2. The present appeal under section 374(2) Cr.P.C. has been preferred by the appellant against the judgment and order dated 25.11.2006 passed by Additional Sessions Judge/Fast Track Court No. 2, District Siddharth Nagar in Special Session Trial No. 07 of 2006.

3. As per the office report dated 21.07.2023 a report of CJM concerned dated 06.07.2023 has been received stating therein that the sole appellant has died. The said report has been sent after due inquiry.

4. This Court has perused the said report which states that the accused-appellant has died.

5. In view of the same, the appeal stands abated.

6. File consigned to records.

7. The trial court records, if received, be sent back along with the communication of this order. Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
