Modification Application No. 6 of 2022

1. Present modification application has been filed seeking modification of the order dated 22.09.2021 passed by this Court. Contention of the counsel for the applicant is that an order was passed by this Court disposing of the writ petition with a direction to consider the claim of the petitioner.

2. It is argued that subsequent to the judgment passed by this Court, claim of the petitioner has been rejected by means of a fresh order dated 11.11.2021 stating that Board does not have the jurisdiction to pass an order. Be that as it may once, the fresh order has been passed it is open to the applicant to challenge the same by filing appropriate fresh proceedings, if so advised.

3. Modification Application is disposed off.

Order Date :- 2.8.2023
