Heard Shri Dileep Kumar Gautam, learned counsel for the petitioner.
Contention of learned counsel for the petitioner is that the petitioner's services were regularized on 18.11.2007 and prior thereto the petitioner had rendered services which are not being counted for computation of the petitioner's services. He places reliance on the judgment of this Court dated 06.09.2021 passed in Writ - A No.41962 of 2016 [Braj Mohan Sharma and Ors. v. State of U.P. & Ors.].
Considering the fact that the claim of the petitioner is yet to be decided, the present petition is disposed off directing respondent no.3 i.e. District Magistrate, Prayagraj to decide the claim of the petitioner, particularly for the services rendered by him prior to regularization and pass an order with regard to the pensionary benefits entitlement of the petitioner with all expedition, preferably within a period of four months from today.
While taking a decision, the respondent shall consider the judgment of this Court in the case of Braj Mohan Sharma & Ors. (supra).
