Sri Ankit Srivastava, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Chhedi against the judgment and order dated 30.10.2003 passed by the Additional Sessions Judge/Fast Track Court No. 1 in Sessions Trial No. 592 of 1994, Police Station Gulariha, District Gorakhpur.

As per office report dated 12.10.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 27.08.2022 informed that the appellant-Chhedi has died two years ago. In support of which a report of concerned police station and the copy of death certificate issued by the State Government and village pradhan have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
