Sri Ankit Srivastava, learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Bhurey Khan against the judgment and order dated 18.01.1990 passed by Special Judge, Budaun in Sessions Trial No. 71 of 1988, Police Station Sahaswan, District Budaun.

As per office report dated 18.10.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 04.10.2022 informed that the appellant-Bhurey Khan has died on 01.08.202. In support of which a report of concerned police station and the copy of death certificate issued by village pradhan and the copy of the statements of the other witnesses have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
