1. Heard Sri Udai Bhan Pandey, learned counsel for applicant as well as Sri Aniruddha Singh, learned counsel for opposite party.

2. Both learned counsel have vehemently informed this Court that the order of the writ court dated 28.10.2021 passed in Writ Petition No.24881 (MS) of 2021 has been complied with and Election Petition has been decided by the Prescribed authority/SDM, Tarabganj, Gonda on 18.05.2022.

3. Considering the fact that the order of the writ court dated 28.10.2021 passed in Writ Petition No.24881 (MS) of 2021, has been complied with, it cannot be said that the opposite parties now run in contempt of the orders of this Court. Accordingly, the contempt petition is dismissed leaving it open to the applicant to challenge the said order before appropriate Court in appropriate proceedings.

4. In pursuance to the notices issued to opposite parties no.2 and 3, who are office bearer of Bar Association, have appeared before this Court and have assured that they will not resort to frequent call of the strike by the Bar Association unless the same is for some unprecedented situation as prescribed in the judgment of the Supreme Court in the cases of Ex-Capt. Harish Uppal Vs. Union of India and another reported in 2003 (2) SCC 45 and Hussain and another Vs. Union of India reported in 2017 (5) SCC 702 as well as of this Court in the case of Vinod Kumar Vs. Naib Tehsildar, and Ors., Misc. Single No. 23446 of 2019.

6. This Court duly accepts the apology and the undertakings given by the opposite parties no.2 & 3 and hopes that normal functioning of the Revenue Court shall be permitted without resorting to frequent call for strike/boycott of judicial work.
