The parties have agreed upon settlement of this appeal on the following terms and conditions:

"1). That the present appeal has been filed by the claimants seeking enhancement of the judgment/award dated 23.05.2006 passed by MACT, Shahjahanpur, in MACP No. 2 of 2005.

2) The appellant nos. 1 to 3/respondent no??.shall be entitled to get Rs. 6,10,000/- (Six lac ten thousand) in full and final satisfaction of his/their claim from appellant/respondent no. 1.

3). The amount already deposited/received shall be adjusted towards the total amount due.

4). The amount due as above shall be deposited/paid through cheque within 30 days from the date of receipt of copy of the order of the Hon'ble Court failing which interest @ 12% P.A. shall accrue from such date till payment."

That nothing beyond the above shall be payable to the Claimants by the Insurance Company.

That the said settlement/compromise is being arrived at between the parties through mutual consent, of their own free will and without any undue influence/coercion.

Parties to act as per compromise deed.

This appeal is disposed of in view of the settlement between the parties.
