Cr. Misc. Correction Application No.3 of 2022.
From perusal of the judgment and order dated 15.12.2008 passed by the Trial Court, it is evident that the applicant Ramesh @ Munna was convicted for the offence under section 307 I.P.C. and also under sections 147, 148, 302/149, 201 and 404 I.P.C. While allowing the bail application, vide order dated 24.2.2014 the conviction under section 307 I.P.C. of the appellant Ramesh @ Munna has not been noted. Hence, the present correction application has been filed.
It may be noted that the mistake had occurred in the bail application which has been filed on behalf of the applicant. In the prayer of the bail application, Section 307 I.P.C. has not been added and hence it skipped from inclusion in the bail order.
As prayed by the learned counsel for the applicant, permission is granted to make necessary correction in the prayer clause of the bail application within the course of day.
Having perused the judgment of the trial court, in the 6th line from the bottom in the second paragraph at page '3' of the judgment and order dated 24.2.2014, "Section 307 I.P.C." be added between "302 and 201", as mentioned therein.
The correction application is accordingly, allowed.
