Heard learned standing counsel for the appellant and Sri Siddharth Khare, learned counsel for the respondent.

This Special Appeal has been filed praying to set aside the judgment and order dated 15.09.2021 in Writ A No. 9071 of 2015 (Naumi Lal Vs. State of U.P. and another), passed by the learned Single Judge.

In the second round of litigation the candidature of respondent - petitioner was cancelled on the ground that he was allotted 19 marks on account of applying under homeguard quota.

We repeatedly asked the learned standing counsel for the appellant to show either from the advertisement or any other evidence that any marks for interview was allocated for homeguard category for applicants having experience as homeguard or there is any material on record to show that 19 marks were awarded to the petitioner in interview on account of experience as homeguard.

Despite our above query, the learned counsel for the appellant could not show that 19 marks in interview were awarded to the respondent - petitioner merely on account of his alleged experience certificate of homeguard.

Under the circumstances, we do not find any illegality in the impugned judgment and order dated 15.09.2021, passed by the learned single judge.

Special Appeal is totally devoid of merit and is, therefore, dismissed.
