It is argued by learned counsel for the petitioner that against the order dated 29.11.2021 passed by the Consolidation Officer, Tehbarpur Azamgarh, two appeals being Appeal No.1451 of 2021 (Hafizullah and others Vs. Surendra and others) and Appeal No.1165/1457 were filed in the year 2021. It is argued that both the appeals were filed against the same order, therefore, they shall be heard together and be decided by a common judgement.
Heard learned counsel for the parties.
From perusal of the record, it is clear that against the order dated 29.11.2021, two appeals were filed which is still pending before the Settlement Officer of Consolidation, Azamgarh.
With the consent of learned counsel for the parties, the present writ petition is disposed of with the observation that in case the petitioner wants to decide both the appeals by a common judgment, he may file an appropriate application in this regard before the appellate authority within a period of three weeks from today. If such an application is filed within the stipulated period, the appellate authority shall decide the same expeditiously and preferably within a period of two months thereafter.
